CONCERNING
STIPULATION OF TARIFF OF IMPORT DUTY ON IMPORT OF GOODS IN THE FRAMEWORK
OF EARLY HARVEST PACKAGE (EHP) BILATERAL INDONESIA-CHINA FREE TRADE AREA (FTA)

THE MINISTER OF FINANCE,

Considering:

a. that, imposition of tariff of import duty on import of goods in the framework of Early Harvest Package (EHP) Bilateral Indonesia-China Free Trade Area (FTA) as stipulated in Decree of the Minister of Finance No. 356/KMK.01/2004 as already amended by Regulation of the Minister of Finance No. 09/PMK.010/2005 is in accordance with Attachment to the above Decree of the Minister of Finance for 2004-2006;
b. that, to create a legal framework to ensure Early Harvest Package (EHP) Bilateral Indonesia-China Free Trade Area (FTA), it is necessary to confirm that stipulation of tariff of import duty for 2006 as set forth in Decree of the Minister of Finance No. 356/KMK.01/2004 as has already been amended by Regulation of the Minister of Finance No. 09/PMK.010/2007 is valid as from January 1, 2007;
c. that, based on the considerations as described in paragraphs a and b, it is necessary to stipulate Regulation of the Minister of Finance on Stipulation of Tariff of Import Duty on Import of Goods in the Framework of Early Harvest Package (EHP) Bilateral Indonesia-China Free Trade Area (FTA);

In view of:

1. Law No. 10/1995 on Customs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612) as has already been amended by Law No. 17/2006 (Statute Book of 2006 No. 93, Supplement to Statute Book No. 4661);
2. Presidential Decree No. 48/2004 on Ratification of Framework Agreement on Comprehensive Economic Cooperation Between the Association of South East Asian Nation and the People’s Republic of China (Statute Book of 2004 No. 50);
3. Presidential Decree No. 20/P/2005;
4. Decree of the Minister of Finance No. 101/KMK.05/1997 on Customs Manifest as has already been amended several times and latest by Regulation of the Minister of Finance No. 48/PMK.04/2005;
5. Regulation of the Minister of Finance No. 56/PMK.010/2005 on Program of Reduction/Cancellation of Tariff of Import Duty in the Framework of Normal Track ASEAN-China Free Trade Area (FTA);
6. Decree of the Minister of Finance No. 355/KMK.01/2004 on Stipulation of Tariff of Import Duty on Import of Goods in the Framework of Early Harvest Package (EHP) ASEAN-China Free Trade Area (AC-FTA);
7. Decree of the Minister of Finance No. 356/KMK.010/2004 on Stipulation of Tariff of Import Duty on Import of Goods in the Framework of Early Harvest Package (EHP) Bilateral Indonesia-China Free Trade Area (FTA) as has already been amended by Regulation of the Minister of Finance No. 09/PMK.010/2005;
8. Regulation of the Minister of Finance No. 110/PMK.010/2006 on Stipulation of System of Classification of Goods and Imposition of Tariff of Import Duty on Import Goods;

HAS DECIDED:

To stipulate:

REGULATION OF THE MINISTER OF FINANCE ON STIPULATION OF TARIFF OF IMPORT DUTY ON IMPORT OF GOODS IN THE FRAMEWORK OF EARLY HARVEST PACKAGE (EHP) BILATERAL INDONESIA-CHINA FREE TRADE AREA (FTA).

Article 1

Stipulating tariff of import duty on import of goods in the framework of Early Harvest Package (EHP) Bilateral Indonesia-China Free Trade Area (FTA) for 2006 as set forth in Attachment to Decree of the Minister of Finance No. 356/KMK.01/2004 on Stipulation of Tariff of Import Duty in the Framework of Early Harvest Package (EHP) Bilateral Indonesia-China Free Trade Area (FTA) as has already been amended by Regulation of the Minister of Finance No. 09/PMK.010/2005 to become tariff of Early Harvest Package (EHP) Bilateral Indonesia-China Free Trade Area (FTA) valid since January 1, 2007.

Article 2

The Director General of Customs and Excise is instructed to implement the provisions of this Regulation.

Article 3

This Regulation comes into force as from the date it is stipulated and retroactive from January 1, 2007.

For Public cognizance, this Regulation is published in the State Gazette of the Republic of Indonesia.
